Services: TRIBALOS offers a variety of services on its communication platform which together are referred to as the "Services". On this platform, and through the user licence, Users can share information, texts, graphics or other material which is uploaded, downloaded or which appears in the Services.
Users: Those persons who subscribe to the Services offered by TRIBALOS . Similarly, users are those who are expressly authorised by the subscribing party.
Content: Information, texts, graphics or other material which is uploaded or downloaded by the users or which appears in the Services.
Licence: The user, on subscribing to the Services offered by TRIBALOS will acquire a USER Licence for the environment and the Services which TRIBALOS offers through its communication platform.
These general Service Conditions ("Conditions") govern the user's access, use of TRIBALOS 's Services and websites, and any information, texts, graphics or other material which is uploaded or downloaded or which appears in the Services (hereinafter "Content"). Access and use of these Services is dependent on acceptance and agreement with these Conditions.
TRIBALOS offers users a web communication platform for collaboration and communication in order to store, manage, edit and share files, schedules, tasks, contacts, electronic mail and instant messages. This communication platform is hosted in a secure server environment.
Users are liable for the use of these Services, the data, information and documentation which is uploaded, downloaded or which appears on the platform, as well as any Content which users publish in these Services and for any other consequence that may result.
Users may make use of these Services only if they accept a binding contract with TRIBALOS , and may only receive these services in accordance with the laws of Spain or any other applicable jurisdiction. Users may make use of these Services only in accordance with these Conditions and any applicable local, state, national or international laws, rules or regulations.
Any Content which the user assigns, presents, publishes or exhibits shall only be visible to the users, third parties and websites which the user has authorised.
The Services which TRIBALOS provides are always developing and the manner and nature of those Services may change at any moment without prior notice.
Any information which the user provides to TRIBALOS is subject to our Privacy policy, which governs the collection and use of the user's information. Through the use of these Services, the user agrees to the collection and use of this information, including the transfer of said information to the United States and/or other countries for storage, handling or use by TRIBALOS .
As part of the process for providing these Services to the user, TRIBALOS may send the user certain communications, such as public service announcements or administration messages. These communications are considered as part of the Services of the user's account in TRIBALOS and it is not possible to configure the service so as not to receive them.
When users express interest in obtaining additional information about the Service or when they register in order to use the Service, TRIBALOS requests contact information, such as name, company name, address, telephone number and e-mail address. When the subscribing to the Service, TRIBALOS requests that the user provides the Company with its financial requirements and invoicing information, such as invoice name and address, credit card number and the number of employees within the organisation who will use the Service. TRIBALOS may request additional information, such as the company's annual income, the number of workers or the industrial sector ("Optional Information").
TRIBALOS shall not review, share, distribute or give any Client Data as a reference, unless stipulated in its General Subscription Agreement or by Law. The individual entries of the User Data may only be consulted, or accessed, in order to solve problems, for help issues or for an alleged violation of the General Subscription Agreement or if required by law. Users are responsible for maintaining the security and confidentiality of their TRIBALOS username and password.
For registered users, TRIBALOS provides tools to access and modify the personal information which has been provided to TRIBALOS and which is associated with the user account.
The user is responsible for protecting the password used to access the Services and the activities or actions carried out with said password.
TRIBALOS is not, and shall not be, liable for any loss or damages caused by the user in complying with the above-mentioned conditions.
Liability for all Content publicly or privately uploaded or downloaded in the platform falls on the author of said Content.
TRIBALOS does not supervise or control the published Content which is uploaded or downloaded via said "Services" and is not liable for said Content.
Any use of, or reliance on, any of these Contents or materials published through this Service, or obtained by the user through these Services is at the user's risk.
TRIBALOS does not approve, support, represent or guarantee the truthfulness, accuracy or reliability of any Content or notice published through the Services nor does it support any opinion expressed through these Services.
Under no circumstances and to no extent shall TRIBALOS be liable for any Content, including, but not limited to, any error or omission in the Content, loss or damage of any type arising as a result of the use of any published Content, sent by e-mail, transmitted or made available through the Services or issued in other dissemination media.
The user reserves the rights for any Content published, uploaded or downloaded through the Services.
TRIBALOS will only act as a tool for processing the data and Services which the user downloads.
Storage of the user's data, information, text or graphics has been subscribed for hosting on secure external servers.
The user is liable for the use of these Services, for any Content and consequences that may result, including the use of its Content by other users and by third parties authorised by the user. Users understand that their Content may be retransmitted by our associates and it shall be the users' liability if they do not possess the right to present said Content for that use.
The user declares and guarantees that it has all the rights, powers of attorney and authority necessary to assign the rights granted in this document for any Content which the user sends.
TRIBALOS provides the user with a personal licence, with worldwide coverage, free of royalties and without exclusivity for the use of this software which TRIBALOS offers as part of the Services. The only purpose of this license is to allow the user to use and enjoy the benefits of the Services provided by TRIBALOS in the manner stipulated herein.
All rights, ownership or interest in and for the Services (excluding the Content provided by the users) are, and shall continue to be, the exclusive property of TRIBALOS and its assignors.
The services are protected by author rights, registered trademark and other laws both in Spain and in other countries.
These Conditions do not at any moment grant any rights to the user to use the name, registered trademark, logo, domain or other distinctive characteristic of the trademark. User rights refer to the use of the Services.
Any response, comment or suggestion which the user provides with regard to TRIBALOS or these Services is completely voluntary and TRIBALOS is free to use such information, comments or suggestions as it considers appropriate without any obligation towards the user.
TRIBALOS reserves the right at all times (and without any type of obligation) to delete or refuse to distribute any Content in these Services and to block users or recover usernames.
TRIBALOS also reserves the right to access, read, keep and disclose any information which it considers necessary to (I) comply with any current law, regulation, legal processes or governmental requests, (II) apply the Conditions, including any investigation about infringement thereof, (III) detect, prevent or challenge possible frauds and technical or security problems, (IV) respond to requests for help from users, or (V) protect the rights, property or security of TRIBALOS , its users and of the general public.
TRIBALOS does not disclose identifying personal information to third parties except in accordance with its Privacy Policy.
The user is not authorised to perform any of the following actions upon accessing or using these Services: (I) accessing, improperly handling or using the non-public areas of TRIBALOS 's Services, computing systems or the technical systems of TRIBALOS 's providers, (II) examining, scanning or testing the vulnerability of any system, or connecting, breaching or passing through any security measure, (III) accessing, researching or attempting to access or research the Services by any method (whether automated or not) which is not through the interfaces which TRIBALOS has provided and published (and only in accordance with the above-mentioned general Conditions), unless the user has been specifically authorised to do so in an additional agreement with TRIBALOS , (IV) falsifying any TCP/IP heading or any part of the heading information in any e-mail or publication, or using the Service in any manner to send identifying information of the altered, misleading or false source, or (V) interfering or damaging (or attempting to do so) access of any user, service or network, including, but not limited to, sending viruses, overloading, flooding, sending junk mail or bombarding the Services with e-mails, or using a script to create the Content in such a manner that it interferes or generates an undue load on the Services.
TRIBALOS uses tools to collect information which are in common use, such as "cookies" and "web beacons" to gather certain information as people navigate through the Company's websites (the "Information on Website Navigation"). This section describes the types of information on website navigation which TRIBALOS may collect and also the manner in which the Company may use such information.
Cookies: TRIBALOS uses cookie technology to collect additional data on the use of the website in order to improve TRIBALOS 's Service, but in many parts of the Services they are not necessary, such as in the search section or in access to the users' profiles or public lists. A cookie is a small information file which is transferred to the computer's hard drive. TRIBALOS may use both session cookies and persistent cookies in order to have a better understanding of the user’s interaction with Service, in order to control the users' use in general, traffic flows and to improve TRIBALOS 's services. Most browsers automatically accept cookies. Users may configure their browser, changing the options in order to stop accepting cookies or to ask before accepting cookies from the websites which the user visits.
If you choose to identify yourself personally to TRIBALOS , the Company uses session cookies, which contain coded information which allows the Company to identify you uniquely. Each time that you start a Service session, a session cookie, which contains a coded and unique identifier linked to your account, is installed in your browser. These session cookies allow the Company to identify you uniquely when you start a Service session and are also used to process transactions and orders online. Session cookies are indispensable for using the Service.
TRIBALOS may use information from the session and permanent cookies in combination with the Data of TRIBALOS Users in order to provide them with information relating to the Company and the Service.
Web Beacons: TRIBALOS uses web beacons alone or in combination with the cookies to collect information about how users and visitors use the Company's websites and the interaction with their e-mail messages. Web beacons are clear electronic images which can recognise certain types of information on your computer, like cookies, when you visit a particular website linked to the web beacon, as well as recognising the description of a website linked to said web beacon. TRIBALOS uses these web beacons to operate and improve the website and e-mail communications. TRIBALOS may use the information from the Web beacons in combination with the Data of TRIBALOS Users in order to provide them with information about the Company and about the Service.
IP Addresses: When you visit TRIBALOS websites, Internet Protocol (IP) addresses are collected in order to carry out an overall and complete monitoring of the information which does not identify you personally.
TRIBALOS also collects IP addresses from users when they start the Service Session as part of the security elements, such as "Identity Confirmation" and “IP range restrictions".
TRIBALOS will use the user data to carry out the requested services.
TRIBALOS may also use the user data for commercial purposes, as well as to send you information about the Company and its partners, such as information about promotions or events.
TRIBALOS will only use credit card information to verify the financial requirements of possible users and to collect payment for the Service.
TRIBALOS uses solid security measures to protect user data with regard to unauthorised access, to maintain data accuracy and to ensure proper use of user data.
TRIBALOS also implements an advanced security measure based on dynamic data and on coded session identifiers. TRIBALOS hosts its website in a secure server environment, which uses firewalls and other advanced technology to prevent interference or access by external intruders. TRIBALOS offers improved security characteristics within the Service. These characteristics allow users to configure their security preferences to the level which they consider necessary.
Given that the Company uses the Service to maintain TRIBALOS ’ user data, this information is guaranteed in the same manner as described above for user data.
TRIBALOS is not liable for the data or information which the users may publish, upload or download in the communication platform.
TRIBALOS will respond to notifications of alleged infringement of copyrights which are according to current law and which are appropriately provided to TRIBALOS . If the user believes that its Content has been copied in a manner which infringes copyrights, TRIBALOS requests the following information: (I) physical or electronic signature of the owner's author rights or of the person authorised to act on their behalf. (II) Identification of the property which possesses the copyrights which allegedly have been infringed. (III) Identification of the property which has allegedly been infringed or which is subject to infringement of its copyrights and which must be deleted or to prohibit access to that which must be disabled, and all pertinent information so as to allow TRIBALOS to locate the material. (IV) The user's information, including address, telephone number and electronic address, (V) the declaration from the user that it believes in good faith that the material in accordance with the manner in which it has been exhibited is not authorised by the holder of the copyrights, its representative or by the law, and (VI) a declaration confirming that the information in the notification is accurate and, under penalty of perjury, that the user is authorised to act in representation of the holder of the copyrights.
TRIBALOS reserves the right to remove allegedly infringing Content without prior notice and under its own discretion. Under certain circumstances, TRIBALOS may also close a user's account if the user is a repeat infringer.

To the maximum extent allowed by applicable law, TRIBALOS and its subsidiaries, affiliates, officers, employees, agents, partners and licenses shall not be liable for damages whether they be direct, indirect, incidental, special, consequential or punitive including, without limitation, loss of profits, data, use, goodwill or other intangible losses, as a result of (I) the user’s access or use or inability to access or use the Service, (II) any Content or conduct of any third party relating to the services including, without limitation, any slander, offence or illegal act by users or third parties, (III) any Content obtained from the services, (IV) any damages directly arising from providing the hosting service contracted out to an external provider, and (V) unauthorised access, use or alteration of its transmissions or Contents, whether based on guarantees, breach of duty (including negligence) or any other legal concept.
Some jurisdictions do not allow exclusion from certain guarantees or exclusion or limitation of liability for consequent and/or fortuitous damages. Consequently, the above-mentioned limitations may not be applicable.
Third parties contracted by TRIBALOS are responsible for performing certain functions and for providing services to TRIBALOS .
TRIBALOS may share the user's personal information with third parties, but only to the extent necessary to perform its functions and to provide services and only in accordance with the obligations which reflect the protections under the privacy policy.
TRIBALOS is not liable for damages which users may suffer in the service given its providers, providing there is a direct link between the damages and the service offered by this provider. The user expressly agrees to hold TRIBALOS harmless for the services contracted out to third parties.
Failure by TRIBALOS to ensure compliance with any right or provision in these Conditions shall not be considered as assignment of such right or provision. In the event that any provision in these Conditions is invalid or inapplicable, the remaining provisions herein shall remain fully in force.
These Conditions or any action relating thereto shall be governed by the laws of the State of Spain, without taking into account or application the clauses in conflict with the laws of the state or country where the user resides.
Any claim, legal procedure or lawsuit arising in relation to these Services, legal procedures or lawsuits based on the Services shall take place only in the Courts of the city of Barcelona, and the user accepts this jurisdiction and the location of said courts and waives any objection relating to the inconvenience of these courts.
These Conditions, the regulations and TRIBALOS 's privacy policy are of total agreement between TRIBALOS and the user according to the Services (excluding any service for which the user has another type of agreement with TRIBALOS which is explicitly additional to, or in place of, these Conditions), and these Conditions substitute or replace any previous agreement between TRIBALOS and the users relating to these Services.
TRIBALOS may revise these Conditions occasionally; the most current version can be found in Spain. If the revision, under the sole discretion of TRIBALOS , is significant, TRIBALOS will inform the user by e-mail to the mail account associated with the user's account. Upon continuing to access or use these Services after said revisions enter into force, the user shall accept agreement with said revisions.
At all times, TRIBALOS will act in application of the provisions of Organic Law 15/1999, 13 December, on Personal Data Protection, as well as its subsequent amendments.
TRIBALOS provides this Privacy Policy in order to inform the user of our policies and procedures relating to the collection, use and disclosure of the information received by TRIBALOS from the users of TRIBALOS 's websites. On using TRIBALOS 's Services, the user agrees to the collection, storage, disclosure or use of this information as stipulated in these Conditions in Spain and in any country in which TRIBALOS operates irrespective of the place where the user lives or enters their data.
